El Tribunal Supremo declara que el pago de la hipoteca debe ser pagada a partes iguales entre los cónyuges divorciados

La Sala de lo Civil del Alto Tribunal ha valorado el interés casacional de un recurso interpuesto por un divorciado, que solicitaba extinguir la sociedad legal de gananciales y que los bienes que existieran a nombre suyo y de su ex esposa se distribuyeran a partes iguales, así como las cargas que gravitaban sobre el matrimonio. En una sentencia de la que ha sido ponente la magistrada Encarnación Roca Trías, el Supremo se ha hecho eco de las sentencias contradictorias que han emitido diferentes Audiencias Provinciales en relación con el carácter que ostenta el crédito hipotecario que grava la vivienda familiar en caso de disolución de sociedad de gananciales. De este modo, ha fijado que el pago de las "cuotas de la hipoteca correspondiente a la hipoteca contratada por ambos cónyuges para la adquisición de la propiedad del inmueble destinado a vivienda familiar constituye una deuda de la sociedad de gananciales, y no una carga del matrimonio".En casos de cese de la convivencia por divorcio o separación, el Supremo reconoce que debe primar la protección de los hijos aunque este criterio haya producido como resultado, "no deseable en general", dejar de lado las reglas del régimen de bienes que rigen la forma de adquisición del matrimonio. UN JUZGADO FIJÓ QUE PAGARA EL 80% DE LA HIPOTECA En cualquier caso, reafirma que el préstamo hipotecario no constituye carga familiar sino que afecta al aspecto patrimonial de las relaciones entre los cónyuges, y añade que esta solución también fue adoptada por el artículo 231.5 del Código Civil de Cataluña.En concreto, el Supremo ha estimado el recurso de Javier M.D. contra la sentencia dictada en septiembre de 2007 por la Audiencia Provincial de Valencia que imponía al progenitor una mayor contribución al pago del préstamo hipotecario teniendo en cuenta sus posibilidades económicas y considerándolo como "aportación dentro de la pensión alimenticia". Antes de acudir al Supremo, el hombre recurrió a la Audiencia Provincial la decisión de un juzgado de Lliria (Valencia) que ordenó que pagara el 80 por ciento de las cuotas mensuales de la hipoteca tras el divorcio. |
